END ALS Website "ONE VOICE ONE HOPE" Terms and Conditions of Use

1. Application

These terms and conditions of use will apply to all videos and accompanying user information submitted to "ONE VOICE ONE HOPE," a content offered on the website (the "Website") operated by General Incorporated Association END ALS (the “Website Operator”). By uploading, the user of the Website (the “User”) will be deemed to have agreed to all of the terms written herein.

2. Use of Uploaded Videos by the Website Operator

With the aim of increasing awareness and understanding of ALS and promoting action by various stakeholders (the "Aim"), video content uploaded by the User ("Uploaded Video") will be placed on the Website where it will be viewable by a wide Internet audience. The User's nickname will be disclosed. Furthermore, the copyright of the Uploaded Video upon uploading will belong to the Website Operator. For the purpose of achieving the Aim, the Website Operator will have the right to use the Uploaded Video on a worldwide, exclusive, royalty-free basis, and the User will agree not to exercise author’s moral rights with regard to the Uploaded Video.

3. Response to Prohibited Usage

In cases where usage prohibited in these terms and conditions of use are found, the Website Operator will have the right to pull the Uploaded Video from public viewing based on its own judgment without advance notice to the User. The User will agree not to challenge any and all response taken by the Website Operator, including the pulling of the Uploaded Video from public viewing and deletion of the uploaded data file.

4. Prohibited Usage

The following are prohibited during use of the Website by the User:
- Uploading of video that includes content expressing meaning other than that of the word assigned by the Website.
- Uploading of video that includes the use of a person’s image without consent, unauthorized visual or audio recording of trademarks, or copyrighted materials and/or other content that infringes upon the rights of any third party.
- Usage that puts excessive strain on the Website’s server.
- Actions that obstruct the operation of the Website.
- Actions that obstruct the usage of the Website by other users.
- Actions that go against public order and morality or common sense.
- Other actions that the Website Operator judges inappropriate.

5. Disclaimer

The Website Operator will pay utmost attention when putting up information on the Website, but this does not guarantee the accuracy or integrity of the information.

The Website Operator will not assume any responsibility for direct or indirect damages caused by the User using or being unable to use the Website (including having uploaded or being unable to upload video).

If the User violates any of the terms and conditions of use written herein and/or causes any damage to the Website Operator, other users, or any third parties in relation to the use of the Website (including uploading), the User shall handle and solve the matter at their own responsibility and cost, without any inconvenience or damage being applied to the Website Operator.

Any communication or other charges incurred as a result of using the Website shall be borne by the User. The Website Operator will be exempt from responsibility even in cases where a dispute arises between the User and a third party with regard to communication and other charges.

6. Applicable Law / Superiority of Japanese Version

These terms and conditions of use shall be governed by and construed in accordance with the laws of Japan, and the Tokyo District Court shall be the exclusive agreement jurisdictional court of the first instance. Only the Japanese version of the Website and the terms and conditions of use shall prevail for interpretation. Translations in other languages are only provided for the convenience of the User and will not be referred to for interpretation of the terms herein.

7. Operation of the Website and Revisions to Terms and Conditions of Use

The terms and condition of use may be changed or modified at the discretion of the Website Operator without any prior notice. If the User uploads material after changes to the terms and conditions of use come into effect, then the User will be deemed to have agreed to all of the modifications.

The Website may be modified or terminated for any reason, without notice at any time.
